Pregnant Young Mother Wrongfully Evicted by Revengeful Landlord
Landlord Allen Kaul and his family threw a pregnant young woman’s belongings out of what was rightfully her home, twice, without warning, not only publicly humiliating her but causing her ongoing stress and worry. The Kaul family’s actions have been documented and the consequences will be decided in the Superior Court hearing where the ex-tenant is hoping to be granted compensation in excess of $15,000.
Miami, Florida (PRunderground) August 22, 2008 - How would you react if your landlord refused to carry out basic but essential maintenance on your condo when you were several months pregnant? Of course you would file a complaint to the local condo association so that something could be done. What would you then do if that very same landlord evicted you and your 9 month old baby without warning in the middle of the night, in a revengeful attack?
From the very start of the accommodation contract between a 27 year old mother and landlord Mr. Allen Kaul there were sanitary problems within the Miami condo. Despite the young woman’s requests for basic maintenance to be carried out, Mr. Kaul did not comply. For a pregnant mother and 9 month old baby to be living in an apartment with a pre-existing ant infestation, a broken shower and a toilet that was backing up waste into the bathroom was unacceptable. Something needed to be done and a complaint was filed to the local condo association in Miami-Dade County, Florida. The young woman also signed a statement to assist the condo association with pre-existing prosecutions being made against Mr. Kaul in order to gain action.
Then, at the dead of night on July 16th, 2008 when the young woman was not in the condo, Mr. Kaul and his family visited the property being leased to the young mother, threw her and her baby son’s belongings from the second story balcony and changed the door locks. Somehow they had found out about the tenants attempt at getting something done about the unsanitary conditions of her home and decided to retaliate. Since the young woman had prepaid the three month rental in the amount of $3,600,and an initial maintenance fee before moving in, there was no legitimate reason for these insensitive and irrational actions.
Not knowing quite what to do, the tenant called the Police who arrived at the condo building and informed Mr. and Mrs. Kaul that in order to evict a tenant he must go through the appropriate legal proceedings. Both parties agreed that something would be done to sort the problem out, yet the revengeful landlord failed to return his tenants belongings undamaged.
My Kaul’s revengeful act didn’t only happen once. Just four days later Mr. Kaul had again effectively evicted the tenant without warning and moved a member of his own family in.

For the mother of a 9 month old baby who is also pregnant to come home to find her belongings strewn across the street is unimaginably distressing. Having been rushed to the Emergency Room on several occasions following the two events, she continues to suffer mentally and physically, is at high risk of miscarriage and has great fears for the health of her unborn child.
The Police were once again called but Mr. Kaul and his wife continued to show no remorse or intention to fix their wrongdoings. As an experienced landlord with over 14 managed properties in the city of Miami, Mr. Kaul and his wife, who is a licensed Realtor, should have known better than to treat a tenant with such discourtesy. For a landlord to neglect his duty to carry out basic maintenance on a property he is leasing is one concern in itself, but for Mr. Alan Kaul to then evict an expectant mother without informing her, twice, is simply an intolerable act of vengeance. The young woman has filed a lawsuit against Mr. and Mrs. Kaul in the Miami Superior Court and is suing for damages in excess of $15,000, not to mention the court fees.

Mr. Kaul made a verbal agreement for the tenancy to begin in April 2008, when the mental and financial damages to the young woman first began due to poor living conditions. Five months later in August of the same year the case is ongoing and this stress continues to have its effects. Whether Mr. & Mrs. Kaul will be entitled to carry on leasing to the general public remains unseen and the result of this case has not yet been established.
