Success for Black Fox Metalcraft With the Aid of Virtuoso Legal

It is truly galling when a small artisan producer has their creative designs and copyright simply copied by a much bigger company. Black Box Metalcraft sought the assistance of the UK’s leading intellectual property company; award-winning Virtuoso Legal. 

In September 2015, the directors of Black Fox discovered that several of their weathervane designs were being offered for sale on another company’s eBay page. As can be seen from illustrations below, the other company’s designs were identical to Black Fox’s designs.

Black Fox quickly contacted the seller to see if there had been a mistake, but received no response. Black Fox then wrote a formal letter to the company, but Black Fox’s pleas for their designs to be removed from sale fell on deaf ears. Black Fox soon realised that the damage wasn’t just to their existing client base and sales but also to their reputation for producing original top quality well made designs.

At this point, the directors of Black Fox sought the assistance of the team of intellectual property experts at Virtuoso Legal, who prepared formal letter before action in relation to copyright infringement against both the seller company and its directors. After some poor excuses from the infringing company and its lawyers, the infringing company eventually agreed to cease all use of Black Fox’s intellectual property, remove all the above designs from any publications, and to pay Black Fox a sum in relation to damages and legal costs.

Black Fox Metalcraft are now content in knowing that their prized weathervane designs are not being sold by another company, as well as having their legal costs paid by the other side.
