What is the California Lemon Law?

“The Lemon Law is a body of law that protects consumers from faulty vehicles that do not meet design and/or quality standards”, says California Lemon Law Attorney Liz Gayle, managing attorney of Gayle Law Group PC. “If your vehicle has  repeatedly been in for repair of problems and you are getting nowhere with the dealership, there is a good chance you may qualify for a buyback of your vehicle.”

The official name of the Lemon Law in California is the Song-Beverly Consumer Warranty Act.

Lemon laws exist at both the federal and state levels and were created in order to provide remedies for consumers who purchase or lease a vehicle that repeatedly fails to meet the standards of quality and performance.

Does your vehicle qualify under Lemon Law guidelines?

“Most people do not realize how strong California’s consumer protections are. If you purchased or leased a new or used vehicle in California and have had an ongoing problem or problems with the vehicle that a dealer has unsuccessfully attempted to fix on multiple repair visits, you may qualify for recovery under the Lemon Law. Legal representation is 100% free and can be provided at no-cost to you. The manufacturer will be responsible for covering legal costs, not you”, says Attorney Liz Gayl

“This is why it is important to get legal help if you have gone to the dealership multiple times and gotten nowhere. Often times, just having an attorney involved causes all the parties involved [the manufacturer and dealership] to move more quickly in resolving the issue.”

Examples of Lemon Law Cases

A 2020 Dodge RAM with 10,000 miles on the odometer has been in the shop two times for stalling and is still having the same problem. The dealer pulled codes from the computer both times and changed parts to try to repair it, but it has stalled once again since being serviced.

A 2018 Audi A6 was leased for 4 years in January 2018 and now has 24,000 miles. The bumper to bumper warranty is 4/50,000. It has been returned to the dealer for repairs four times for air conditioning issues that were verified by the dealership, but have still not been resolved.

What should you do if you feel your vehicle is a “lemon”?

The simple answer is speak to an attorney about your case and see if your vehicle qualifies under California Lemon Law.
