How an Assignment of Benefits Lawsuit led a mitigation contractor to help other contractors avoid insurance disputes.

For over 15 years Marc Onesta’s crime scene cleanup company was called out by victim’s family members to grisly and disturbing scenes to remove the remnants of bodily fluids and tissues. The once crime scene cleaner no longer performs biohazard cleanup services since starting Biohazard Claims Group, a St.Petersburg Florida based estimate review service that analyzes biohazard invoices billed to insurance carriers. “I work for all insurance carriers nationwide in evaluating the work done by some of the same biohazard clean up companies I used to compete against”, says owner Marc Onesta.

Mr. Onesta started Biohazard Claims Group the beginning of 2020 after a dispute with an insurance carrier over his crime scene cleanup invoice led to an Assignment of Benefits lawsuit often called an AOB suit. Mr.Onesta states the dispute started when the insurance carrier hired an unqualified water damage review service to evaluate his company’s biohazard -crime scene cleanup invoice. The water damage review service revised my invoice to 1/3rd what he billed for using the wrong cost components says Onesta. Mr.Onesta knew this was a problem in the biohazard industry and didn’t want other biohazard companies to go through what he did if he could help it, so he began the process of closing down his blood cleanup service to start his estimate review company.

In the biohazard cleanup industry there are remediation companies who charge fair market rates and other companies that do not, my job is to make sure this industry is not tarnished by remediation contractors who price gouge victims families and insurance carriers, states Onesta. Mr.Onesta says that his review company evaluates contractor estimates differently than other services, by asking the right questions involved in the cleanup process. Mr.Onesta states he has performed over 1000 type biohazard/ blood cleanup jobs in his career as a biohazard cleanup contractor and he uses his actual field experience to effectively analyze invoices.
