“As I tell all of our clients, it is critical to see an employment lawyer at various stages of the employment relationship, including before you sign the contract or offer letter as there may be important limitations on your right to severance contained in the agreement,” Jarret says.

He advises employees not to wait till they resign or are terminated to seek advice. “We encourage employees to be proactive in seeking employment advice-even if only for a brief consult-before making any decision to resign from a position or to accept a severance proposal,” he says.
