Traumatic Brain Injury, or closed head injury, can occur from a blow to the head, a car accident, a slip and fall, or medical negligence. In the obvious cases an MRI, or CT scan will show swelling or bleeding of the brain and diagnoses may range from mild concussion to TBI.

A New York Times article (Ken Belson, Dec. 3, 2012) discussed how researchers from Boston University Center for the Study of Traumatic Encephalopathy, the Veterans Affairs Boston Healthcare System and Sports Legacy Institute studied posthumous brain samples of people who suffered repeated mild traumatic brain injury. The study revealed that 80% of those studied showed evidence of chronic traumatic encephalopathy, a degenerative brain disease.

Ronemus said that “expert testimony is critical in proving cases that have to do with the brain, as the injuries and severity of the problem is not visibly evident to a jury.” The jury concluded that the plaintiff was profoundly disabled from the injury to her brain, and the 10.8 million dollar verdict included lost earnings, future medical costs and pain and suffering.

Difficulty concentrating, loss of coordination, dizziness, personality changes, irritability, blurry vision, headaches, nausea, and fatigue are just a smattering of the variety of symptoms of TBI.
